The agreement covering your use of Explain This

By accessing or using the Explain This website and document explanation service (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you don't agree, please don't use the Service. If you're using the Service on behalf of an organisation, you're confirming you have authority to bind that organisation to these Terms.

Explain This uses artificial intelligence to read documents you upload or paste and produce a plain-English explanation, a summary of key points, and — where relevant — suggested questions to raise with a qualified professional. The Service is a general information tool, not a substitute for professional advice, and it does not review your specific circumstances the way a qualified professional would.

Explanations produced by the Service are generated automatically and are provided for general informational purposes only. They are not legal, medical, financial, tax, insurance, or other professional advice, and using the Service does not create a lawyer-client, doctor-patient, financial adviser, or any other professional relationship between you and Explain This. You should independently verify anything important against the original document and consult a qualified, licensed professional in your jurisdiction before making decisions based on it. You are solely responsible for any decisions or actions you take, or don't take, in reliance on the Service.

The Service uses artificial intelligence, which can misread, misinterpret, omit, or otherwise get details wrong — especially in complex, unusual, poorly scanned, or non-English documents. We work to make explanations accurate and useful, but we don't guarantee that any explanation is complete, accurate, current, or free of errors. Always cross-check important details — dates, amounts, obligations and deadlines — against your original document.

You must be at least 18, or the age of majority where you live, and able to form a legally binding contract to use the Service, particularly to make a purchase. You don't need an account to try your first document; an account is created automatically the first time you purchase document credits. You're responsible for keeping your account credentials confidential and for all activity under your account.

You keep ownership of any document or text you submit (“Your Content”). By submitting Your Content, you grant us a limited, worldwide licence to use, copy, store and process it solely to provide and improve the Service to you, subject to our Privacy Policy. You confirm that you have the right to share Your Content — for example, that it isn't confidential information you're not permitted to disclose, and that it doesn't infringe anyone else's rights. Don't upload another person's sensitive personal information unless you're authorised to do so.

You agree not to: use the Service for anything unlawful; upload malware or attempt to interfere with, overload, or disrupt the Service; attempt to reverse-engineer, scrape at scale, or extract our underlying models or other users' data; use the Service to generate content that is defamatory, harassing, or infringes others' rights; or circumvent any usage limits, security measures or the credit system. We may suspend or terminate access for breaching this section.

Your first basic explanation is free. Additional use is paid for using document credits purchased in packs, as described on our Pricing page — there's no subscription and nothing recurring. Prices are shown in Australian dollars (A$) unless stated otherwise and may change for future purchases, though changes won't affect credits you've already bought. Purchased credits are valid for 12 months from the date of purchase, are for your use only, and are non-transferable. Payments are processed by a third-party payment processor, and by making a purchase you also agree to that processor's applicable terms.

Credit packs are generally sold on a non-refundable basis, except as required by law. If you're a consumer in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. You're also entitled to have services re-supplied, or to a refund, for a failure that doesn't amount to a major failure. Nothing in these Terms is intended to limit or exclude those guarantees, or any other right you have under the law of the country you live in that can't be excluded.

Explain This, its logo, design, and underlying software are owned by us or our licensors and protected by intellectual property law. Except for Your Content, nothing in these Terms gives you any rights to our trademarks, branding or technology.

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or available at all times.

To the maximum extent permitted by law: (a) Explain This will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the Service; and (b) our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (i) the total amount you paid us in the 12 months before the claim arose, or (ii) A$100. This limitation applies regardless of the legal theory the claim is based on, and even if we've been advised of the possibility of the damages. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including consumer guarantees under the Australian Consumer Law.

To the extent permitted by law, you agree to indemnify and hold Explain This harmless from any claims, losses, damages and expenses, including reasonable legal fees, arising from your misuse of the Service, Your Content, or your breach of these Terms.

We may suspend or terminate your access to the Service if you breach these Terms, misuse the Service, or if we reasonably believe it's necessary to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination — including limitation of liability, indemnity, and intellectual property — will continue to apply.

We may update these Terms from time to time, for example to reflect changes to the Service or the law. If we make material changes, we'll update the “Last updated” date above and, where reasonably practicable, provide notice on the site. Continuing to use the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Australia, without regard to conflict-of-law principles, and any dispute will be subject to the non-exclusive jurisdiction of the courts of Australia — without limiting any additional, non-excludable rights or protections you have under the mandatory laws of the country in which you live, if different.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
